Update (1920ET): NHK reports another case of a “seriously ill” patient in Tokyo. The man allegedly traveled to Indonesia – one of the few countries in the region that hasn’t confirmed a single case – while he was sick.

Update (1820ET): Officials in Hubei have reported their latest figures on the outbreak, with the number of new cases doubling compared to yesterday (630 on Saturday new cases vs. 366 on Friday), while the number of confirmed deaths dipped (96 vs 106).

Rule by Fiat: National Crises, Fake Emergencies and Other Dangerous Presidential Powers

Who pays the price for the dissolution of the constitutional covenant that holds the government and its agents accountable to the will of the people?

We all do.

This ill-advised decision by President Trump to circumvent the Constitution’s system of checks and balances by declaring a national emergency in order to build a border wall constitutes yet another expansion of presidential power that exposes the nation to further constitutional peril.

It doesn’t matter that the legal merits of this particular national emergency will be challenged in court.

The damage has already been done.

As reporter Danny Cevallos points out, “President Donald Trump only had to say ‘national emergency’ to dramatically increase his executive and legal authority. By simply uttering those words … Trump immediately unleashed dozens of statutory powers available to a president only during a state of emergency. The power of the nation’s chief executive to declare such an emergency knows few strictures — it was designed that way.”

We have now entered into a strange twilight zone where ego trumps justice, propaganda perverts truth, and imperial presidents—empowered to indulge their authoritarian tendencies by legalistic courts, corrupt legislatures and a disinterested, distracted populace—rule by fiat rather than by the rule of law.

This attempt by Trump to rule by fiat merely plays into the hands of those who would distort the government’s system of checks and balances and its constitutional separation of powers beyond all recognition.

This is about unadulterated power in the hands of the Executive Branch.

This is about corporate greed disguised as a national need.

Beware the Emergency State: Imperial, Unaccountable and Unconstitutional

It’s all happening according to schedule.

The civil unrest, the national emergencies, “unforeseen economic collapse, loss of functioning political and legal order, purposeful domestic resistance or insurgency, pervasive public health emergencies, and catastrophic natural and human disasters,” the government’s reliance on the armed forces to solve domestic political and social problems, the implicit declaration of martial law packaged as a well-meaning and overriding concern for the nation’s security…

The government has been planning and preparing for such a crisis for years now.

No matter that this crisis is of the government’s own making.

To those for whom power and profit are everything, the end always justifies the means.

This latest brouhaha over President Trump’s threat to declare a national emergency in order to build a border wall is more manufactured political theater, a Trojan Horse intended to camouflage the real threat to our freedoms: yet another expansion of presidential power exposing us to constitutional peril.

This is not about illegal immigration or porous borders or who will pay to build that wall.

Cybersecurity Expert John McAfee Issues Warning About Those Cell Phone “Presidential Alerts”

With the push of a button and at the direction of President Donald Trump, a “Presidential Alert” was sent to all cellphones across America at 2:18 p.m. ET yesterday.

The message was the first test of what many are calling the “Presidential Alert” system, a new way to notify Americans across the country of national emergencies.

Here’s what it looked like, in case you were one of the few who didn’t get the alert, or you don’t have a cell phone:

A 2015 law called the Integrated Public Alert and Warning System Modernization Act limits the scope of what can be considered a valid emergency alert:

Except to the extent necessary for testing the public alert and warning system, the public alert and warning system shall not be used to transmit a message that does not relate to a natural disaster, act of terrorism, or other man-made disaster or threat to public safety.

The idea for this system was sponsored by Senator Ron Johnson (R-Wisconsin) and signed into law by then-President Barack Obama.

Despite the wording of the message, this is not a presidential alert system, explains Law & Crime:

It is a Wireless Emergency Alert system set up by the Federal Emergency Management Agency (FEMA) to allow government officials to swiftly send information to the American public in a time of crisis, specifically terror attacks, natural disasters, or other public safety threats.

The alert everyone got this week was not sent by Trump, despite the misleading title. It was sent by FEMA as a test of the system. In the future, the president will have the ability to send messages, as will other officials from federal, state, tribal, and local governments.
