EPA Decides Not to Regulate Fracking Wastewater as Pennsylvania Study Reveals Recent Spike

On April 23, the U.S. Environmental Protection Agency (EPA) told two environmental groups that it had decided it was “not necessary” to update the federal standards handling toxic waste from oil and gas wells, including the waste produced by fracking.

State regulators have repeatedly proved unable to prevent the industry’s toxic waste from entering America’s drinking water supplies, including both private wells and the rivers from which public drinking water supplies are drawn, the Environmental Protection Agency concluded in a 2017 national study.

The corrosive salt-laden wastewater from fracked wells has been spread on roads as a de-icer. It’s been sprayed into the air in the hopes of evaporating the water — a practice that spreads its blend of volatile chemicals into the air instead. Oil industry wastewater has even been used to irrigate crops — in California, where state regulators haven’t set rules to keep dangerous chemicals like the carcinogen benzene out of irrigation water.

If equally contaminated waste came from other industries, it would usually be designated hazardous waste and subject to strict tracking and disposal rules designed to keep the public safe from industrial pollution. But in July 1988, after burying clear warnings from its own scientists about the hazards of oilfield waste, the EPA offered the oil and gas industry a broad exemption from hazardous waste handling laws.

The EPA’s decision this week echoes that.

EPA Plans to Allow Unlimited Dumping of Fracking Wastewater in the Gulf of Mexico

Environmentalists are warning the Environmental Protection Agency (EPA) that its draft plan to continue allowing oil and gas companies to dump unlimited amounts of fracking chemicals and wastewater directly into the Gulf of Mexico is in violation of federal law.

In a letter sent to EPA officials, attorneys for the Center for Biological Diversity warned that the agency’s draft permit for water pollution discharges in the Gulf fails to properly consider how dumping wastewater containing chemicals from fracking and acidizing operations would impact water quality and marine wildlife.

The attorneys claim that regulators do not fully understand how the chemicals used in offshore fracking and other well treatments — some of which are toxic and dangerous to human and marine life — can impact marine environments, and crucial parts of the draft permit are based on severely outdated data. Finalizing the draft permit as it stands would be a violation of the Clean Water Act, they argue.

The EPA is endangering an entire ecosystem by allowing the oil industry to dump unlimited amounts of fracking chemicals and drilling waste fluid into the Gulf of Mexico,” said Center attorney Kristen Monsell. “This appalling plan from the agency that’s supposed to protect our water violates federal law, and shows a disturbing disregard for offshore fracking’s toxic threats to sea turtles and other Gulf wildlife.”

The Center has a history of using legal action to stop polluters and challenge the government to enforce environmental regulations, so the letter could be seen as a warning shot over the EPA’s bow.

The first known oil well in Oklahoma happened by accident. It was 1859 and Lewis Ross was actually drilling for saltwater(brine), not oil. Brine was highly valued at the time for the salt that could be used to preserve meat. As Ross drilled deeper for brine, he hit oil. And people have been drilling for oil in Oklahoma ever since.

Lewis Ross might find today’s drilling landscape in the Sooner State somewhat ironic. The oil and gas industry, which has surging production due to horizontal drilling and fracking, is pumping out huge volumes of oil but even more brine. So much brine, in fact, that the fracking industry needs a way to dispose of the brine, or “produced water,” that comes out of oil and gas wells because it isn’t suitable for curing meats. In addition to salts, these wastewaters can contain naturally occurring radioactive elements and heavy metals.

But the industry’s preferred approaches for disposing of fracking wastewater — pumping it underground in either deep or shallow injection wells for long-term storage — both come with serious risks for nearby communities.

In Oklahoma, drillers primarily use deep injection wells for storing their wastewater from fracked shale wells, and while the state was producing the same amount of oil in 1985 as in 2015, something else has changed. The rise of the fracking industry in the central U.S. has coincided with a rise in earthquake activity.

From 1975 to 2008, Oklahoma averaged from one to three earthquakes of magnitude 3 or greater a year. But by 2014, the state averaged 1.6 of these earthquakes a dayIt now has a website that tracks them in real time.

The U.S. is setting new oil production records as horizontal drilling and fracking open up shale deposits in places like North Dakota and Texas.

Fracking is based on the “hydraulic” process of using pressurized liquid to shatter shale rock to let the oil and gas inside escape. And while that liquid is a mixture of many hazardous chemicals, it is mostly water. And acquiring that water and then properly disposing of the toxic wastewater produced by fracking is becoming a big and expensive problem for the industry.

Gabriel Collins is a fellow in energy and the environment at Rice University, and in August he gave a presentation at the Produced Water Society Permian Basin 2018 event in Midland, Texas. There, Collins presented a business case for starting a large water processing company to service the fracking industry.

One sign that the fracking industry is becoming concerned about water is that there are now societies and conferences dedicated to the topic of “produced water.” Produced water is the term for the toxic water that is “produced” over the life of a fracked oil or gas well.

In a story by Bloomberg News, Collins said he didn’t believe investors were aware of the risks that water poses to the fracking industry in the Permian Basin.

Over the same time, the total amount of water used for fracking rose roughly half as much, 770 percent, according to the paper published today in the journal Science Advances.

Previous studies suggested hydraulic fracturing does not use significantly more water than other energy sources, but those findings were based only on aggregated data from the early years of fracking,” Avner Vengosh, professor of geochemistry and water quality at Duke’s Nicholas School of the Environment, said in a statement. “After more than a decade of fracking operation, we now have more years of data to draw upon from multiple verifiable sources.”

The researchers predict that spike in water use will continue to climb.

And over the next dozen years, they say the amount of water used could grow up to 50 times higher when fracking for shale gas and 20 times higher when fracking for oil — should prices rise. The paper, titled “The Intensification of the Water Footprint of Hydraulic Fracturing,” was based on a study conducted with funding from the National Science Foundation.

Even if prices and drilling rates remain at current levels, our models still predict a large increase by 2030 in both water use and wastewater production,” said Andrew J. Kondash, a PhD student in Vengosh’s lab who was lead author of the paper.

More Water than Oil

The shale industry has been heavily focused on amping up the amount of fossil fuels it can pump per well by drilling longer horizontal well bores and using more sand, water, and chemicals when fracking (which raises the costs per well and, as DeSmog recently reported, raises risks of water pollution).

Here’s the New Study the Fracking Industry Doesn’t Want You to See

Using human bronchial epithelial cells, which are commonly used to measure the carcinogenesis of toxicants, researchers confirmed fracking flowback water from the Marcellus Shale caused the formation of malignancies.

After conducting further tests on live mammalian subjects, researchers found five of six mice “injected with cells transformed from well water treatments developed tumors as early as 3 months after injection,” including a tumor in one mouse that grew to over 1 cm in size in just five months. A control group did not develop any tumors for the six months of the study period.

According to the study, performed by scientists from the Department of Environmental Medicine, as well as Biochemistry and Molecular Pharmaceutical at New York University, the Robert Wood Johnson Medical School at Rutgers, and esteemed partners from universities in China — results indicate fracking flowback water causes cancer.

Implications of the report’s findingswould be difficult to overstate considering how fracking wastewater is generated, stored, and treated, and how often spills, leaks — and even the wastewater injection process, itself — can lead to contamination of the potable supply. A concise but thorough explanation of the fracking process can be found in the introduction to the report, “Malignant human cell transformation of Marcellus Shale gas drilling flow back water,” which states:

“Natural gas is believed to possibly be a bridge to transitioning from coal dependence. Currently natural gas fuels nearly 40% of the U.S. electricity generation, and the Marcellus Shale formation in the Appalachian Basin is on the forefront of gas-shale drilling for natural gas production in the United States.

Dear California readers: if you drank tapwater this morning (or at any point in the past few weeks/months), you may be in luck as you no longer need to buy oil to lubricate your engine: just use your blood, and think of the cost-savings. That’s the good news.

Also, the bad news, because as the California’s Department of Conservation’s Chief Deputy Director, Jason Marshall, told NBC Bay Area, California state officials allowed oil and gas companies to pump up to 3 billion gallons (call it 70 million barrels) of oil fracking-contaminated waste water into formerly clean aquifiers, aquifiers which at least on paper are supposed to be off-limits to that kind of activity, and are protected by the government’s EPA – an agency which, it appears, was richly compensated by the same oil and gas companies to look elsewhere.

And the scariest words of admission one can ever hear from a government apparatchik: “In multiple different places of the permitting process an error could have been made.”

Because nothing short of a full-blown disaster prompts the use of the dreaded passive voice. And what was unsaid is that the “biggest error that was made” is that someone caught California regulators screwing over the taxpayers just so a few oil majors could save their shareholders a few billion dollars in overhead fees.
