Pentagon Brands ‘Belligerent’ Journalists As Legitimate “Enemy Combatant” Targets

The Pentagon has released an 1,176-page book of instructions on the “The Law Of War” detailing acceptable ways of killing the enemy. The manual also states that journalists can be labeled “unprivileged belligerents,” an obscure term that replaces the Bush era “unlawful enemy combatant.”

As The Washington Times reports, an eye-catching section deals with a definition of journalists and how they are expected to stay out of the fight –

“In general, journalists are civilians. However, journalists may be members of the armed forces, persons authorized to accompany the armed forces, or unprivileged belligerents.”

While the Pentagon did not specify the exact circumstances under which a journalist might be declared an unprivileged belligerent, lumping terrorist writers with bona fide reporters prompted a civilian lawyer who opines on war crime cases to call the wording “an odd and provocative thing for them to write.”

Michael Rubin, a Middle East expert at the American Enterprise Institute, said the manual reflects today’s muddled world of journalism.

“It’s a realization that not everyone abides by the same standards we do,” said Mr. Rubin. “Just as Hamas uses United Nations schools as weapons depots and Iran uses charity workers for surveillance, many terrorist groups use journalists as cover.”

Mr. Rubin recalled that two al Qaeda terrorists posed as journalists to assassinate anti-Taliban leader Ahmad Shah Massoud. Chechen Islamists went on missions with camera crews.

“Journalists are the new consultant. Anyone can claim to be one,” he said. “No American serviceman should ever be killed because a politician told them they had to take a foreign journalist at his or her word.”

As RT adds,

The 1,176-page “Department of Defense Law of War Manual” explains that shooting, exploding, bombing, stabbing, or cutting the enemy are acceptable ways of getting the job done, but the use of poison or asphyxiating gases is not allowed.

Surprise attacks and killing retreating troops have also been given the green light.

“He made my life miserable for a long time.”

Earlier this year I did an hour long interview with James Risen. We discussed his case with the Department of Justice, where he was being threatened with incarceration for refusing to reveal his source who gave him insights about NSA activities. This was before Obama and Eric Holder decided to drop the prosecution against him.  I saw him give the keynote speech at the luncheon for the Investigative Reporters and Editors 2015 conference and after his talk, in which he lambasted former Attorney General Eric Holder, I asked him to do a brief interview, based on his comments on Obama, Eric Holder and their legacies.

Rob Kall: I was really hoping you would recap what you said to about 1500 journalists about your experience with the DOJ and Eric Holder and where journalism is today.

James Risen: I think the main point I was trying to make is the legacy of the Obama administration on press freedom issues is a bad one. They had, in my case, sought to eliminate what’s called the reporter’s privilege, which is the ability of reporters to protect their confidential sources in criminal trials and not be forced to testify and identify sources. In my case the judge sided with me and quashed the subpoena from the Justice Department against me. But the Obama administration appealed that to the appeals court and they overturned that decision by the lower court and in their appeal to the appeals court, they said, there is no such thing as a reporters’ privilege in a federal case. And the court sided with them and that had the effect of eliminating the ability, legally, of reporters to protect their sources in federal criminal cases.

(Satire): President Obama announced at a White House press conference today that the Trans-Pacific Partnership (TPP) trade treaty details must remain secret because the now 14-year-old US War on Terror requires secrecy from terrorist enemies, secrecy is the founding principle of American freedom, and that secrecy equals safety. Press conference excerpts:

President Obama: As you know, secrecy is a foundational principle of American freedom. From the Founding Father’s secret “Committees of Correspondence,” to Boston’s Old North Church spy signal of “one if by land, two if by sea,” to Alexander Hamilton, James Madison, and John Jay using the secret name, “Publius,” to publish The Federalist Papers to win support for our Constitution, American patriots have used secrecy to protect our great nation. Secrecy equals freedom.

This is why the current Trans-Pacific Partnership treaty, TPP, is a classified national security secret that cannot be disclosed to the public, even four years or more after it is passed into law. Secrecy keeps Americans safe.

I also remind everyone that America is fighting a War on Terror, and that even after 14 years of brave combat and support of the American public, the terrorists are not defeated. War requires secrecy to keep our troops as safe as possible. TPP makes America stronger, which supports our troops.

Q: Sir, what about the “fast track” that violates the US Constitutional requirement that all treaties be ratified by the Senate under at least 2/3 vote?

 

Obama: The United States is a democracy. Fast track authority was passed into law by Congress. When Congress has the votes and the President approves, that’s the law of the land.

Q: I’m sorry, Mr. President; but how can Congress and you violate the Constitution by ignoring the 2/3 vote requirement just because you say so?

Revealed: How DOJ Gagged Google Over Surveillance of Wikileaks Volunteer

The Obama administration fought a legal battle against Google to secretly obtain the email records of a security researcher and journalist associated with WikiLeaks.

Newly unsealed court documents obtained by The Intercept reveal the Justice Department won an order forcing Google to turn over more than one year’s worth of data from the Gmail account of Jacob Appelbaum (pictured above), a developer for the Tor online anonymity project who has worked with WikiLeaks as a volunteer. The order also gagged Google, preventing it from notifying Appelbaum that his records had been provided to the government.

The surveillance of Appelbaum’s Gmail account was tied to the Justice Department’s long-running criminal investigation of WikiLeaks, which began in 2010 following the transparency group’s publication of a large cache of U.S. government diplomatic cables.

According to the unsealed documents, the Justice Department first sought details from Google about a Gmail account operated by Appelbaum in January 2011, triggering a three-month dispute between the government and the tech giant. Government investigators demanded metadata records from the account showing email addresses of those with whom Appelbaum had corresponded between the period of November 2009 and early 2011; they also wanted to obtain information showing the unique IP addresses of the computers he had used to log in to the account.

Congress members are often pressured in how to vote by the moneyed interests that buy their television ads, which in turn persuade the media to “cover” them nicely and dumb people to vote for them. But more often they are pressured in how to vote by the leaders of their two mega-parties who in turn answer to greater moneyed interests.

Thus three Republicans who voted against their leader’s wishes in one of a package of votes intended to ram through the Trans-Pacific Partnership disaster have now been stripped of their leadership positions.

But carrots are used as often as sticks. In May 2009, 60 congress members voted against dumping another $97 billion into the wars on Iraq and Afghanistan. My own misrepresentative Tom Perriello voted for it. Then, in June 2009, 202 congress members voted against that same war funding combined with a massive bailout for East European bankers. Perriello voted for both, even though both progressives AND the Tea Partiers in his district were opposed. The White House immediately rewarded him. Van Jones and Steny Hoyer came down to this district and did events, and shortly later the Secretary of Agriculture did the same. They were all rather pointless events intended as oppotrunities to pose for cameras with Perriello. Obama later did one himself.

At the end of last week, 28 Democrats voted against the interests of Obama, which happen to be identical on the TPP as on so many things with the interests of the Republican leadership. Some of those Democrats may not have needed carrots or sticks. But some clearly got them. Four in particular, we know, were given a ride in a aeroplane. Wheeeeee! Obama took them to the G7 with him on Air Force One. They are the four horses asses of the coming TPP apocalypse.  They are:

Trans-Pacific-Partnership (TPP) is “secret national security legislation” that President Obama and both parties’ “leaderships” refuse to disclose to the American public, and only visible from WikiLeaks. President Obama attempted “fast track” dictatorial power for Congress to vote for TPP without access to full text or public consideration. “Fast track” violates the US Constitution’s requirement for the Senate to ratify all treaties with 2/3 vote by claiming that 50% is somehow the same (a tie is broken by the VP, so 50% is enough). President Clinton’s justification of “fast track” is here.

TPP is Emperor’s New Clothes’ unconstitutional because it allows a foreign three-person tribunal chosen by the same .01% oligarch powers that created TPP to have power to tax Americans billions of our dollars for claimed “damages” of corporations. These three persons appointed by TPP interests would have dictatorial power to protect corporate claimed “future profits.” From Ellen Brown:

“To date, the highest ISDS award has been for $2.3 billion to Occidental Oil Company against the government of Ecuador over its termination of an oil-concession contract, this although the termination was apparently legal. Still in arbitration is a demand by Vattenfall, a Swedish utility that operates two nuclear plants in Germany, for compensation of €3.7 billion ($4.7 billion) under the ISDS clause of a treaty on energy investments, after the German government decided to shut down its nuclear power industry following the Fukushima disaster in Japan in 2011.”

U.S. President Barack Obama has for years been negotiating with European and Asian nations — but excluding Russia and China, since he is aiming to defeat them in his war to extend the American empire (i.e, to extend the global control by America’s aristocracy) — three international ‘trade’ deals (TTP, TTIP, & TISA), each one of which contains a section (called ISDS) that would end important aspects of the sovereignty of each signatory nation, by setting up an international panel composed solely of corporate lawyers to serve as ‘arbitrators’ deciding cases brought before this panel to hear lawsuits by international corporations accusing a given signatory nation of violating that corporation’s ‘rights’ by its trying to legislate regulations that are prohibited under the ’trade’ agreement, such as by increasing the given nation’s penalties for fraud, or by lowering the amount of a given toxic substance that the nation allows in its foods, or by increasing the percentage of the nation’s energy that comes from renewable sources, or by penalizing corporations for hiring people to kill labor union organizers — i.e., by any regulatory change that benefits the public at the expense of the given corporations’ profits. (No similar and countervailing power for nations to sue international corporations is included in this: the ‘rights’ of ‘investors’ — but really of only the top stockholders in international corporations — are placed higher than the rights of any signatory nation.)

This provision, whose full name is “Investor State Dispute Resolution” grants a one-sided benefit to the controlling stockholders in international corporations, by enabling them to bring these lawsuits to this panel of lawyers, whose careers will consist of their serving international corporations, sometimes as ‘arbitrators’ in these panels, and sometimes as lawyers who more-overtly represent one or more of those corporations, but also serving these corporations in other capacities, such as via being appointed by them to head a tax-exempt foundation to which international corporations ‘donate’ and so to turn what would otherwise be PR expenses into corporate tax-deductions. In other words: to be an ‘arbitrator’ on these panels can produce an extremely lucrative career.

The Origin & Broader Context of Obama’s ‘Trade’ Deals

U.S. President Barack Obama’s proposed ‘Trade’ deals are actually about whether the world is heading toward a dictatorial world government — a dictatorship by the hundred or so global super-rich who hold the controlling blocks of stock in the world’s largest international corporations — or else toward a democratic world government, which will be a global federation of free and independent states, much like the United States was at its founding, but global in extent. These are two opposite visions of world government; and Obama is clearly on the side of fascism, an international mega-corporate dictatorship, as will be documented here in the links, and explained in the discussion.

Also as a preliminary to the discussion here is the understanding that if Obama wins Fast Track Trade Promotion Authority, then all of his ‘trade’ deals will be approved by Congress, and that if he fails to receive this Authority, then none of them will.

“Fast Track,” as will be explained in depth here, is, indeed, the “open Sesame” for Obama, on the entire matter. Without it, his deals don’t stand even a chance of passage.

I previously wrote about why it’s the case that “‘Fast Track’ Violates the U.S. Constitution.” The details of the case are presented there; but, to summarize it here: “Fast Track Trade Promotion Authority,” which was introduced by the imperial President Richard M. Nixon in the Trade Act of 1974, violates the U.S. Constitution’s Treaty Clause — the clause that says “The President … shall have power, by and with the advice and consent of the Senate, to make treaties, provided two thirds of the Senators present concur.” (In other words: otherwise, the President doesn’t have that power, the President cannot “make treaties.”

Obama’s Bipolar Approach To Energy And Climate Change

With less than two years to go in office, President Obama has already sealed his fate with regards to his legacy on climate change.

When historians look back and assess his actions on what could be one of the biggest issues of his presidency, they will undoubtedly be using the term “disappointing” quite a bit.

The main problem is not that he has ignored the issue as his predecessor, President George W. Bush, did; it is that he has consistently said one thing about the threat of climate change and then done the exact opposite of what he has called for.

When he was first running for president, Obama made it clear that his approach to energy was an “all of the above” platform that included coal, renewables, oil, natural gas, and even nuclear. This was his way of trying to appease both the fossil fuel interests and those of us who understand that renewable energy is what’s needed to protect the planet.

It isn’t unique for politicians to backtrack on campaign promises. In fact, that is the status quo for the most part, and when you take into consideration the fact that Obama was very up front with us about his energy policy, we cannot accuse him of being dishonest in this situation.

But what is unique in this situation is President Obama’s constant public reminders that climate change is a threat to the United States, proclamations that are typically followed by an anti-environment executive action.

The more things change, the more they stay the same.

It’s a shell game intended to keep us focused on and distracted by all of the politically expedient things that are being said—about militarized police, surveillance, and government corruption—while the government continues to frogmarch us down the road toward outright tyranny.

Unarmed citizens are still getting shot by militarized police trained to view them as the enemy and treated as if we have no rights. Despite President Obama’s warning that the nation needs to do some “soul searching” about issues such as race, poverty and the strained relationship between law enforcement and the minority communities they serve, police killings and racial tensions are at an all-time high. Just recently, in Texas, a white police officer was suspended after video footage showed him “manhandling, arresting and drawing his gun on a group of black children outside a pool party.”

Americans’ private communications and data are still being sucked up by government spy agencies. The USA Freedom Act was just a placebo pill intended to make us feel better without bringing about any real change. As Bill Blunden, a cybersecurity researcher and surveillance critic, points out, “The theater we’ve just witnessed allows decision makers to boast to their constituents about reforming mass surveillance while spies understand that what’s actually transpired ishardly major change.”

The New York Times (NYT) is a trusted source of Administration thinking, particularly in foreign policy, more, an uncanny, sensitive barometer of deep-lying structural-military-diplomatic events which are presently culminating, beyond the New Cold War brewing since Clinton’s international posture in Europe and the Pacific, in the actuality of heated confrontation directed against both Russia and China. Under Obama, the page has turned. No longer can we pretend a chess match in which tough rhetoric and vast expenditures form a comfortable (and highly profitable) surrogate for open warfare, a stage of inner discipline favorable to the suppression of dissent, the creation of industrial-financial-commercial fortunes, and the habituation to violence (transmissible in spirit and acquiescence from urban settings to foreign interventions). Now is different. Capitalism in America has reached the point of definitive sclerosis, a terminal, pathological hardening of the ideological arteries, in which the overgrowth of the fibrous/ interstitial tissue of profit-madness, hubris, and conquest for its own sake, has won out, has defeated whatever has been left of the Constitutional rights of the American formative context. We are a long way from the late 18th century, and with brief exceptions, notably, those brought on by the struggles of the exploited and the persecuted themselves, the progression has been downhill all the way, coinciding with the falsification of government’s public trust and the concentration of private wealth and power.

So what is happening now is not surprising. Upper groups, in their narcissistic death wish, want it all, the entire globe at their feet—and sensing ultimate defeat are prepared to bring the curtain down.

Obama Pharoah - YouTube ScreenshotA horse named “American Pharoah” just won the Triple Crown.  Is this some sort of a sign for America?  The office of the presidency was greatly strengthened under previous administrations, but now Barack Obama has grabbed an unprecedented amount of power for himself.  In this article, I am going to focus on immigration, but Obama’s power grab is certainly not limited to this area.  And as I have written aboutpreviously, if there is some sort of major “national emergency” over the next year or so, the legal framework has already been created for Obama to use his “emergency powers” to take total control of virtually everything.  So is comparing Obama to the pharoahs of ancient Egypt unfair?  I don’t think so at all.  He is certainly acting as if he would like the powers of a dictator, his policies in the Middle East would make the pharoahs proud, and without a doubt Obama loves the adoration and worship of his fans.  In my opinion, he is the closest thing to a pharoah that the United States has ever seen.

Just consider Obama’s approach to immigration.  The laws of our land require him to protect our borders, but he has left them wide open and has openly encouraged illegal immigration because that is what he decided was best.  He also attempted to use his “executive powers” to grant amnesty to millions upon millions of immigrants that were in this country illegally.  Fortunately, that action has been blocked in the courts (at least for now), but Obama says that he is going to keep trying to do everything he can to “bring them out of the shadows”.

Even in the security-über alles climate that followed 9/11, the Patriot Act was recognized as an extreme and radical expansion of government surveillance powers. That’s why “sunset provisions” were attached to several of its key provisions: meaning they would expire automatically unless Congress renewed them every five years. But in 2005 and then again in 2010, the Bush and Obama administrations demanded their renewal, and Congress overwhelmingly complied with only token opposition from civil libertarians.

That has all changed in the post-Snowden era. The most controversial provisions of the Patriot Act are scheduled to “sunset” on June 1, and there is almost no chance for a straight-up, reform-free authorization. The Obama White House has endorsed the so-called “reform” bill called the USA Freedom Act, which passed the House by an overwhelming majority. Yet the bill fell three votes short in the Senate last week, rendering it very unclear what will happen as the deadline rapidly approaches.

Unlike many privacy and civil liberties groups, the ACLU has refrained from endorsing the USA Freedom Act and instead is advocating for allowing the Patriot Act provisions to sunset — i.e., to die a long overdue death rather than being “reformed.” Meanwhile, almost all of the 86 “no” votes in the House were based on the argument that the USA Freedom Act either does not go far enough in limiting the NSA or that it actually makes things worse.

I spoke yesterday with the ACLU’s Deputy Legal Director, Jameel Jaffer, about what is likely going to happen as the June 1 deadline approaches, whether the USA Freedom Act is a net positive for privacy supporters, and what all of this reform means for Edward Snowden’s status. Having enabled billions of dollars worth of militarized equipment to be unloaded into every police department in the nation – only to have alienated the very Americans that hoped for change the most – it appears President Obama is ready to uncross another red line. Following unrest in U.S. cities over the deaths of black men at the hands of police officers,Reuters reports, during his triup to Camden NJ, Obama announced his plans to put in place new restrictions on the use of military equipment by police departments.

Just six months ago, President Obama was discussing increasing the funding for the militarization of America’s police force.

Now, after various riots, deaths, and police excess, he appears to be flip-flopping away from that idea…

As Reuters reports,

Obama will ban police use of equipment such as explosive-resistant vehicles with tracked wheels like those seen on army tanks, the White House said in a fact sheet. For other types of equipment, such as MRAP (mine-resistant ambush protected) vehicles and riot shields, departments will have to provide added justification for their use.

In the aftermath of the Baltimore riots, Obama has been speaking out more about race, including in a speech in the Bronx on increasing opportunity for young minority men and during a panel discussion on poverty in Washington.

“Race issues have been more present over the past year for this country. We’ve seen, since Ferguson, issues that have been bubbling up in communities becoming much more present,” said Rashad Robinson, executive director of colorofchange.org, a group that aims to strengthen the black community’s political voice in America.

Obama’s remarks in Camden will be the fourth time in as many weeks that he has held an event to discuss his ideas for improving life for poor black communities. Obama, the country’s first black president, has often been reticent about discussing race issues.

There is much speculation about US Secretary of State John Kerry’s rush visit to Russia in the wake of Russia’s successful Victory Day celebration on May 9. On May 11, Kerry, who was snubbing Russia on the 9th, was on his way to Russia, and Putin consented to see him on May 12.

As time passes we will find out why Kerry was snubbing Putin on May 9 and 3 days later was criticizing Washington’s puppet regime in Ukraine. For what is known at this time, a possible explanation is that Washington is coming to its senses.

If you watched the 1 hour 20 minute video of the Victory Day Parade, you are aware that the celebration sent a powerful message. Russia is a first class military power, and Russia is backed by China and India, whose soldiers marched with Russia’s in the parade.

So, while the increasingly irrelevant West, absorbed in its own self-importance, snubbed
the celebration of the victory that the Red Army gave them over Hitler, the three largest countries in the world were present united. Russia has the largest land mass, and China and India, also large land masses, have the world’s largest populations.

The celebration in Moscow made it clear that Washington has failed miserably to isolate Russia. What Washington has done is to make the BRICS more unified.

With the President of China sitting at the right hand of Putin, the celebration also made it completely clear even to the morons in the Obama regime that Washington is no longer the Uni-power.
