US Lawmakers Introduce Bill to Kill Prospects for Arms Control

US Senator Tom Cotton and Congresswoman Liz Cheney have introduced a bill that prevents extending the New Strategic Arms Reduction Treaty (New START) with Russia or the Stopping Russia Nuclear Aggression Act. It says “Under no circumstances should the United States agree to extend the New START Treaty beyond the current expiration in 2021 without drastic improvements to the deeply flawed deal.” The bill includes the provision of Russia’s agreement to verifiably reduce its stockpile of tactical nuclear weapons. It also stipulates that the new weapons mentioned in the President Putin’s famous speech in March must be included into the count.

New START limits the US and Russia each to no more than 1,550 deployed strategic warheads and 700 deployed strategic delivery vehicles. Effective since 2011, the agreement covers a 10-year period until February 2021 with the possibility of a five-year extension. So far, the talks on extending the agreement have not been kicked off to the dismay of many arms control wonks.

President Donald Trump has announced his intention to jettison the 1987 Intermediate-range Nuclear Forces (INF) Treaty citing Russia’s alleged “violation” and the “threat” supposedly coming from China.  Decried by the president last year, New START may be next up on the chopping block. He does not like anything done during President Obama’s tenure. The other option is an analog of the 2002 Strategic Offensive Reductions Treaty (SORT), which limited deployed warheads without verification provisions. According to Andrea Thompson, Undersecretary of State for Arms Control and International Security, the future of New Start depends on Moscow’s readiness to limit the new strategic systems President Putin mentioned in his famous speech in March.

There have been ups and downs in the relationship between Russia (the Soviet Union) and the US, but both nations have become accustomed to the fact that their arsenals of offensive nuclear weapons are under the control of an agreement to prevent an arms race in this area. Some type of treaty has been in place since the Partial Nuclear Test Ban Treaty was concluded in 1963. Since 1972, when the first Strategic Arms Limitation Talks (SALT I) agreement was signed, there have always been negotiated constraints on nuclear arsenals. But today, there are ominous signs that the system that has worked so well to push the superpowers back from the brink of the nuclear abyss is being unraveled.

Andrea Thompson, Under Secretary for Arms Control and International Security, speaking before a Senate Foreign Relations Committee hearing on Sept. 18, claimed that Russia’s new strategic weapons that were announced by President Vladimir Putin last March were an obstacle to Washington’s agreement to extend the New START treaty. She also asserted that the issue has not been discussed through the formal New START process. She did not explain why not. The official said the final decision had not been made as yet and, “All options are on the table.” The same applies to the other remaining treaties that Washington is accusing Moscow of violating.

The options under consideration are: withdrawing from the New START; renegotiating the provisions related to the verification process; or signing another treaty instead, such as the 2002 Moscow Treaty or the Strategic Offensive Reductions Treaty (SORT). The undersecretary said that the US administration wanted Russia’s recently unveiled strategic nuclear weapons to be included in the count.

The US Constitution says that only Congress can declare war for an extended time but there is a workaround. Congress approved the 2001 Authorization for Use of Military Force (AUMF), giving the president the authority to track down and destroy al-Qaeda and the Taliban. The resolution stipulates that “The President is authorized to use all necessary and appropriate force against those nations, organizations, or persons he determines planned, authorized, committed, or aided the terrorist attacks that occurred on September 11, 2001, or harbored such organizations or persons, in order to prevent any future acts of international terrorism against the United States by such nations, organizations or persons.” The resolution’s 2002 version gave President Bush the authority to invade Iraq. Only 25 percent of the current members of Congress in the House and Senate were present when the current AUMFs were passed.

Sen. Chris Murphy, D-Conn., and several other Democrats are asking whether a new law authorizing the use of military force should be written. They are planning to introduce legislation that would prohibit Trump from starting a pre-emptive war against North Korea, absent an imminent threat or without express authorization from Congress. They call for one without a sunset date, saying that Congress needs to have a voice.

The deadly incident in Niger last month ignited a push among many members of Congress to update the legal parameters for combat operations overseas. The revelation that the US is at war in Niger, without Congress even knowing, was startling. This is the perfect illustration of the US’s permanent war posture around the world, where battles are waged with little or no public scrutiny and no congressional authorization. All previous attempts to ditch the old authorization and force Congress to craft a new one have failed. For years now, Congress has abdicated its responsibility to debate and vote on US wars.

President Trump Confident in Missile Defense: In the Grip of Dangerous Illusion

The US is pushing ahead with expansion of the nation’s homeland ballistic missile defense (BMD). The effort enjoys strong bipartisan support in Congress and among experts. Many allies place a high value on BMD cooperation with the United States. However, there are ample reasons to question the efficiency of US missile defenses, especially the capability to protect against intercontinental ballistic missiles (ICBMs).

“We have missiles that can knock out a missile in the air 97% of the time,” President Donald Trump said in his interview with Fox News on October 11, adding “and if you send two of them, it’s going to get knocked down.” He was talking about the threat coming from North Korea to be repelled by the Ground-Based Midcourse Defense (GMD) in Alaska and California – the $40 billion project administered by the Missile Defense Agency (MDA).

The US military conducted the first-ever missile defense test involving a simulated attack by an intercontinental ballistic missile in May. The ICBM-type target was fired from the Kwajalein Atoll in the Marshall Islands toward the waters just south of Alaska. The mission was to prepare for countering an intercontinental missile launched by North Korea. The Missile Defense Agency (MDA) described the test as an “incredible accomplishment”. According to Vice Admiral Jim Syring, director of the agency, “This system is vitally important to the defense of our homeland, and this test demonstrates that we have a capable, credible deterrent against a very real threat.” The assessment appears to be exaggerated as the test was not conducted in a realistic environment.

The next test of the GMD system is scheduled for late 2018 and, for the first time, will involve firing two interceptors against one ICBM target. It makes unsubstantiated the president’s affirmation that two interceptors are enough to knock out a North Korean missile as no such tests have been conducted so far.

US Media: Standards Tossed Overboard

Internet development resulted in disappearance of America’s local media to benefit metropolitan mainstream outlets with large countrywide circulation. Predominantly pro-Democratic, they espouse liberal values, paying little attention to political views and everyday life problems of those who live outside megacities.

The mainstream media have lost trust of provincial America to engender the phenomenon of Trump, with public trust in mainstream media reaching its lowest level in history. The people living outside big cities trust President Trump more than media.

There were times US media served all Americans no matter where they lived, while meeting the highest journalism ethics and standards. True, outlets have always been divided to some extent between conservative and liberal camps but media were not antagonistic to each other as they are now. In the 1960s-1980s, the situation was quite different. US media were the real Fourth Estate, revealing the abuse of power and highlighting real problems the country faced.

Media contribution into the Civil Rights Act becoming a law in 1964 and ending the Vietnam War was immense. It’s enough to remember the reports of Walter Cronkite (CBS), often cited as “the most trusted man in America”, about the Vietnam war. His 1968 editorial about the United States “mired in stalemate” in Vietnam was seen by some as a turning point in the US opinion of the war. President Lyndon Johnson is claimed by some to have said, “If I’ve lost Cronkite, I’ve lost Middle America.” Cronkite helped broker the 1977 invitation that took Egyptian President Anwar Sadat to Jerusalem, the breakthrough to Egypt’s peace treaty with Israel.

On September 18, the US Senate voted to ban the use of products from the Moscow-based cyber security firm Kaspersky Lab by the federal government, citing national security risk. The vote was included as an amendment to an annual defense policy spending bill approved by the Senate on the same day. The measure pushed forward by New Hampshire Democrat Jeanne Shaheen has strong support in the House of Representatives, which also must vote on a defense spending bill. The legislation bars the use of Kaspersky Lab software in government civilian and military agencies.

On September 13, a binding directive issued by Acting Secretary of Homeland Security Elaine Duke, ordered federal agencies to remove Kaspersky Lab products from government computers over concerns the Russia-based cybersecurity software company might be vulnerable to Russian government influence. All federal departments and agencies were given 30 days to identify any Kaspersky products in use on their networks. The departments have another 60 days to begin removal of the software. The statement says, «The department is concerned about the ties between certain Kaspersky officials and Russian intelligence and other government agencies, and requirements under Russian law that allow Russian intelligence agencies to request or compel assistance from Kaspersky and to intercept communications transiting Russian networks». The Russian law does not mention American networks, nevertheless it is used as a pretext to explain the concern.

Similar bans against US government use of Kaspersky products have been suggested before. In 2015, Bloomberg News reported that the company has «close ties to Russian spies».

According to US News, scrutiny of the company mounted in 2017, fueled by U.S. intelligence assessments and high-profile federal investigations of Russian interference in the 2016 election. This summer, the General Service Administration, which oversees purchasing by the federal government, removed Kaspersky from its list of approved vendors.
