Breaking: No Action Taken on a Proposal to Repeal Denton, Texas Fracking Ban<\/a><\/h3>\n

Denton’s city council decided not to vote on a repeal of the city’s fracking ban, after almost six hours of discussion on the topic at a public meeting last\u00a0night.<\/p>\n

The vote to repeal the ban was called for shortly after Texas Governor\u00a0Greg Abbott singed\u00a0HB<\/span>40<\/a>\u00a0into law, making Denton\u2019s fracking ban\u00a0illegal.<\/p>\n

Oklahoma’s governor Mary Fallin\u00a0<\/a>signed a similar law on May 31, making bans on the fracking industry illegal there\u00a0too.<\/p>\n

The entire city council and Denton’s mayor Chris Watts\u00a0expressed displeasure with\u00a0HB<\/span>40.<\/p>\n

The mayor disclosed\u00a0that the city\u2019s legal counsel advised that repealing the fracking ban is necessary in order to defeat\u00a0HB<\/span>40.\u00a0 They were told there are better ways to challenge the law than by defending the fracking ban, and that, if the ban isn’t repealed,\u00a0both the Texas General Land Office and the Texas Oil and Gas Association, which have sued to block the ban, could ask for a judgment under\u00a0HB<\/span>\u00a040 that could result in setting a legal\u00a0precedent.<\/p>\n

\u201cIt isn’t just about Denton, anymore,\u201d Councilman Roden told DeSmog before the meeting.\u00a0\u201dHB<\/span>40’s reach goes way behind fracking, it threatens all local ordinances industry doesn’t like.\u00a0Now every city with oil and gas activity\u00a0has to\u00a0grapple with basic questions like, \u2018How can we defend a setback greater than 100\u00a0feet?\u2019\u201d<\/p>\n

Setbacks are the distance that industry must keep its operations from\u00a0homes, schools and businesses.\u00a0The Texas Railroad Commission<\/a>, which regulates the oil and gas industry, has not\u00a0enacted setback distance requirements, so many municipalities have established their\u00a0own.<\/p>\n
