Mississippi Claims Memphis is Stealing its Groundwater, Supreme Court to Decide<\/a><\/h3>\n
A long standing battle between states over water rights is headed to the Supreme Court.<\/strong><\/div>\n<\/div>\n<\/div>\n<\/header>\n

The battle over water rights is heating up. Please consider the\u00a0State of Mississippi v. City of Memphis and Memphis Light, Gas, and Water<\/a>\u00a0now on the Supreme Court Docket.<\/p>\n

Mississippi\u2019s complaint alleges that MLGW has\u00a0\u201cforcibly siphoned\u201d off its water to the tune of billions\u00a0of gallons. Compl. \u00b6 23. And that without modern\u00a0pumping technology none of that water would be available to Tennessee. Id. at \u00b6 24. To make matters worse,\u00a0Mississippi says Tennessee has removed groundwater\u00a0far beyond \u201cthe water\u2019s natural seepage rate.\u201d Id.<\/p>\n

Evidence of Tennessee\u2019s heist, Mississippi claims, can be seen in \u201csubstantial drop in pressure and corresponding drawdown of stored water in the Sparta Sand\u201d and the \u201ccone of depression\u201d that extends into north Mississippi. Id. at \u00b6\u00b6 25, 30. Because Tennessee is allegedly stealing water at such a rapid rate, Mississippi must now drill wells to substantially greater depths. Id. at \u00b6 54(b). Naturally, that practice has increased the costs on Mississippians who rely on the Aquifer for their groundwater.<\/p>\n

Mississippi now seeks both declaratory relief and money damages for the taking of its groundwater. The declaratory judgment would establish Mississippi\u2019s \u201csovereign right, title and exclusive interest in the groundwater stored naturally in the Sparta Sand formation\u201d which would not be available to the Defendants without pumping. I<\/p><\/blockquote>\n

Analysts Favor Tennessee<\/strong><\/p>\n

This suit has been brewing for years. But analysts strongly favor Tennessee.<\/p>\n

For example, the University of Chicago Law Review writer\u00a0Joseph Regalia says\u00a0Mississippi\u2019s Plea to the Supreme Court That It \u201cOwns\u201d Its Water and That Tennessee Is \u201cStealing\u201d It Is Just Wrong<\/a>.<\/p>\n
