{"id":57844,"date":"2021-05-13T08:22:37","date_gmt":"2021-05-13T13:22:37","guid":{"rendered":"https:\/\/olduvai.ca\/?p=57844"},"modified":"2021-05-13T08:22:37","modified_gmt":"2021-05-13T13:22:37","slug":"degrowth-and-law-how-to-combine-these-concepts","status":"publish","type":"post","link":"https:\/\/olduvai.ca\/?p=57844","title":{"rendered":"Degrowth and law \u2013 how to combine these concepts?"},"content":{"rendered":"<div class=\"row-fluid\">\n<div class=\"span12 \">\n<div class=\"post-title\">\n<h3><a href=\"https:\/\/www.degrowth.info\/en\/2021\/05\/degrowth-and-law\/\">Degrowth and law \u2013 how to combine these concepts?<\/a><\/h3>\n<\/div>\n<div class=\"post-image\">\n<div class=\"licensed-image\"><a href=\"https:\/\/www.degrowth.info\/en\/2021\/05\/degrowth-and-law\/\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-501565\" src=\"https:\/\/www.degrowth.info\/wp-content\/uploads\/2021\/05\/Screen-Shot-2021-05-09-at-15.54.15-620x260.png\" width=\"620\" height=\"260\" \/><\/a><cite class=\"license position-bottom position-right\"><\/cite><\/div>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"row-fluid\">\n<div class=\"span12 \">\n<p>Reconciling degrowth and law isn\u2019t always easy, given the\u00a0<a href=\"https:\/\/www.degrowth.info\/en\/catalogue-entry\/an-anarchism-for-today-the-simpler-way\/\">anarchist underpinnings<\/a>\u00a0and\u00a0<a href=\"https:\/\/www.tandfonline.com\/doi\/full\/10.1080\/14747731.2019.1670955?casa_token=1-5FwXRskk4AAAAA%3AGzh1k_0EN4Eh-LXc5z4C5Ius52wyI4vfUzKYLxphU3jde72EGo_YKP4aX8Ko4_2mlCikZQU-MXk\">anti-statist leanings<\/a>\u00a0of some in the degrowth community.\u00a0 One\u00a0<a href=\"https:\/\/www.annualreviews.org\/doi\/pdf\/10.1146\/annurev-environ-102017-025941\">vision of a degrowth world<\/a>\u00a0is of\u00a0<a href=\"https:\/\/link.springer.com\/article\/10.1057\/dev.2011.85\">decentralized, autonomous, convivial communities of<\/a>\u00a0people in tune with their supporting ecosystems, consuming no more than they need, sharing as much as possible and treating each other with compassion, fairness and mutual respect.\u00a0 No central state power, no police, no borders, no masters and servants, no conspicuous consumption, no oppression.\u00a0 This, however, doesn\u2019t necessarily require a world without law, just a world with law that is much different from the forms of law that prevail in today\u2019s rapacious and unjust world.<span id=\"more-501562\"><\/span>\u00a0Humanity\u2019s overarching challenge is to learn how to stop individually and collectively doing harmful things we are used to and conditioned to doing.\u00a0 Meeting that challenge, through degrowth or otherwise, requires some form of law.\u00a0 For reasons that follow, I propose that that the emerging field of ecological law is well suited to help guide a transformation to degrowth societies.<\/p>\n<p>Contemporary law, including environmental law, is anathema to degrowth. Dominant forms of law today are tied to hierarchical structures centered around states and private property, and\u00a0<a href=\"https:\/\/www.mdpi.com\/2071-1050\/5\/1\/316\">contemporary law is a fierce handmaiden<\/a>\u00a0to many aspects of the prevailing neoliberal order, including capitalism, that degrowth challenges.\u00a0 Environmental law is part of this contemporary law.\u00a0 In calling for ecological law that transforms contemporary law, the\u00a0<a href=\"https:\/\/elgaworld.org\/\">Ecological Law and Governance Association\u2019s<\/a>\u00a0(ELGA)\u00a0<a href=\"https:\/\/elgaworld.org\/oslo-manifesto\">Oslo Manifesto<\/a>\u00a0(2016) notes that the roots of environmental law in anthropocentrism, human-nature dualism and individualism has rendered it fragmented, reductionist, blind to ecological interdependencies and weak in comparison to law that protects private interests and state sovereignty.<\/p>\n<p>\u2026click on the above link to read the rest of the article\u2026<\/p>\n<\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Degrowth and law \u2013 how to combine these concepts?
