Former Green leader Elizabeth May assails the act for different reasons.\u00a0<span class=\"caption__media--credit\">Photos via the\u00a0<a href=\"https:\/\/www.greenparty.ca\/en\/meet-elizabeth\" target=\"_blank\" rel=\"noopener noreferrer\">Green party<\/a>\u00a0and the\u00a0<a href=\"https:\/\/www.alberta.ca\/premier.aspx\" target=\"_blank\" rel=\"noopener noreferrer\">Alberta government<\/a>.<\/span><\/figcaption><\/figure>\n<\/div>\n<\/section>\n<article class=\"article__body main-col-container\" data-dev-object-descrip=\"organisms\/article\/article__body\" data-dev-status=\"IN-PROGRESS\">\n<div class=\"container-fluid clearfix \">\n<p class=\"lead-in\">All this week, the Alberta government will be in court challenging the constitutionality of the new federal Impact Assessment Act, with the goal of preventing Ottawa from assessing the impact of coal mining projects in the eastern slopes or new oilsands\u00a0<a href=\"https:\/\/www.nrcan.gc.ca\/our-natural-resources\/energy-sources-distribution\/clean-fossil-fuels\/oil-sands-extraction-and-processing\/18094\" target=\"_blank\" rel=\"noopener noreferrer\">in situ projects<\/a>.<\/p>\n<p>A\u00a0<a href=\"https:\/\/miningwatch.ca\/news\/2021\/2\/22\/environmental-groups-court-defend-federal-environmental-law-attack-government-alberta\" target=\"_blank\" rel=\"noopener noreferrer\">host of environmental groups<\/a>\u00a0including Nature Canada, West Coast Environmental Law and MiningWatch Canada will also be in the Alberta Court of Appeal arguing that the act is constitutional and does not intrude on provincial jurisdiction.<\/p>\n<p>But MP Elizabeth May, the former leader of the Green party and a long-time environmental lawyer, says the federal law is so badly designed, she hopes that the courts will strike it down.<\/p>\n<p>\u201cIt is a very dangerous system and a joke,\u201d May told the Tyee. \u201cI hope the Alberta government wins. It is not proper environmental assessment.\u201d<\/p>\n<p>\u201cBut the motivation of the Kenney government is terrible,\u201d added May who voted against the legislation in 2019.
