{"id":46989,"date":"2019-06-29T07:09:58","date_gmt":"2019-06-29T12:09:58","guid":{"rendered":"https:\/\/olduvai.ca\/?p=46989"},"modified":"2019-06-29T07:10:00","modified_gmt":"2019-06-29T12:10:00","slug":"power-versus-the-press-the-extradition-cases-of-pinochet-assange","status":"publish","type":"post","link":"https:\/\/olduvai.ca\/?p=46989","title":{"rendered":"Power Versus the Press: The Extradition Cases of Pinochet &#038; Assange"},"content":{"rendered":"\n<h3 class=\"wp-block-heading\"><a href=\"https:\/\/consortiumnews.com\/2019\/06\/28\/power-versus-the-press-the-extradition-cases-of-pinochet-assange\/\">Power Versus the Press: The Extradition Cases of Pinochet &amp; Assange<\/a><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">With Julian Assange facing possible extradition from Britain to the U.S. for publishing classified secrets, Elizabeth Vos reflects on the parallel but divergent case of a notorious Chilean dictator.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>E<\/strong>ight months from now one of the most consequential extradition hearings in recent history will take place in Great Britain when a British court and the home secretary will determine whether&nbsp;<em>WikiLeaks&nbsp;<\/em>publisher Julian Assange will be extradited to the United States to face espionage charges for the crime of journalism.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Twenty-one years ago, in another historic extradition case, Britain had to decide whether to send former Chilean dictator Augusto Pinochet to Spain for the crime of mass murder.<\/p>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/consortiumnews.com\/wp-content\/uploads\/2019\/06\/Pinochet_11-09-1982.jpg\" alt=\"\" class=\"wp-image-38022\"\/><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">Pinochet in 1982 motorcade.&nbsp;(Ben2, CC BY-SA 3.0, via Wikimedia Commons)<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In October 1998, Pinochet, whose regime became a&nbsp;<a href=\"https:\/\/www.usip.org\/sites\/default\/files\/resources\/collections\/truth_commissions\/Chile90-Report\/Chile90-Report.pdf\">byword for political killings<\/a>, \u201cdisappearances\u201d and torture, was&nbsp;<a href=\"http:\/\/archive.is\/rZmP\">arrested<\/a>&nbsp;in London while there for medical treatment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A judge in Madrid, &nbsp;<a href=\"https:\/\/www.theguardian.com\/world\/baltasar-garzon\">Baltasar Garz\u00f3n<\/a>, sought his extradition in connection with the deaths of Spanish citizens in Chile.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Citing the aging Pinochet\u2019s inability to stand trial, the United Kingdom in 2000 ultimately&nbsp;<a href=\"http:\/\/archive.is\/irx1\">prevented<\/a>&nbsp;him from being extradited to Spain where he would have faced prosecution for human rights abuses.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At an early point in the proceedings, Pinochet\u2019s lawyer, Clare Montgomery, made an argument in his defense that had nothing to do with age or poor health.&nbsp;&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cStates and the organs of state, including heads of state and former heads of state, are entitled to absolute immunity from criminal proceedings in the national courts of other countries,\u201d&nbsp;the&nbsp;<a href=\"http:\/\/archive.is\/KyUaI#selection-1401.103-1402.0\"><em>&nbsp;Guardian<\/em><\/a>quoted Montgomery as saying.
