The Biggest Threat to US National Security Is the US Government<\/a><\/h3>\n<\/header>\n

A dictatorship does not represent the public but only\u00a0the aristocracy that, behind the scenes, controls the government<\/a>.<\/p>\n

Jonathan H. Adler, Professor at Case Western University School of Law,\u00a0noted<\/a>, regarding George W. Bush\u2019s secret policy for the NSA to access everyone\u2019s phone-records, that \u201cThe metadata collection program is constitutional (at least according to Judge Kavanaugh),\u201d and he presented Judge Kavanaugh\u2019s\u00a0entire published opinion<\/a>\u00a0on that. Kavanaugh\u2019s opinion stated that the 4th Amendment to the US Constitution could be shoved aside because he thinks that the \u2018national security\u2019 of the United States is more important than the Constitution. Kavanaugh wrote:<\/p>\n

The Government\u2019s program for bulk collection of 2 telephony metadata serves a critically important special need \u2013 preventing terrorist attacks on the United States… In my view, that critical national security need outweighs the impact on privacy occasioned by this program…<\/em><\/p>\n

The Fourth Amendment allows governmental searches and seizures without individualized suspicion when the Government demonstrates a sufficient \u201cspecial need\u201d \u2013 that is, a need beyond the normal need for law enforcement \u2013 that outweighs the intrusion on individual liberty\u2026<\/em><\/p>\n

In sum, the Fourth Amendment does not bar the Government\u2019s bulk collection of telephony metadata under this program.<\/em><\/p><\/blockquote>\n

Kavanaugh said that since the 4th<\/sup> Amendment excludes only \u201cunreasonable\u201d searches and seizures (such as seizures of all of this private information from everyone), it doesn\u2019t exclude the \u201cbulk collection of 2 telephony metadata\u201d (collection of both phone numbers in each phone conversation from and\/or to anyone in the United States), because a \u201ccritical national security need [\u201cpreventing terrorist attacks on the United States\u201d] outweighs the impact on privacy occasioned by this program.\u201d<\/p>\n
