The\u00a0<a href=\"https:\/\/www.documentcloud.org\/documents\/4956490-Hardwick-Complaint.html\">suit<\/a> was brought by Kevin Hardwick, an Ohio firefighter, but \u201cseeks relief on behalf of a nationwide class of everyone in the United States who has a detectable level of PFAS chemicals in their blood.\u201d Hardwick is represented by attorney Robert Bilott, who successfully\u00a0<a href=\"https:\/\/theintercept.com\/2015\/08\/17\/teflon-toxin-case-against-dupont\/\">sued DuPont<\/a>\u00a0on behalf of people in West Virginia and Ohio who had been exposed to PFOA from a plant in Parkersburg, West Virginia.<\/div>\n<div class=\"PostContent\">\n<p>In addition to 3M, DuPont, and its spinoff, Chemours, the suit names\u00a0eight other companies that produce the toxic chemicals, which are used to make <a href=\"https:\/\/theintercept.com\/2018\/02\/10\/firefighting-foam-afff-pfos-pfoa-epa\/\">firefighting foam<\/a>, nonstick cookware, waterproof clothing, and many other products. While much of the litigation around PFAS has focused on PFOA and PFOS, this suit targets the entire class of PFAS chemicals, including \u201cthe newer \u2018replacement\u2019 chemicals, such as\u00a0<a href=\"https:\/\/theintercept.com\/2016\/03\/03\/new-teflon-toxin-causes-cancer-in-lab-animals\/\">GenX<\/a>.\u201d<\/p>\n<p>Rather than suing for cash penalties, the suit seeks to force the companies to create an independent panel of scientists \u201ctasked with thoroughly studying and confirming the health effects that can be caused by contamination of human blood with multiple PFAS materials.\u201d Such a panel would parallel the <a href=\"http:\/\/www.c8sciencepanel.org\/\">C8 Science Panel<\/a>, which was created by the earlier class action litigation in West Virginia.
