{"id":37032,"date":"2018-08-24T10:01:11","date_gmt":"2018-08-24T15:01:11","guid":{"rendered":"http:\/\/olduvai.ca\/?p=37032"},"modified":"2018-08-24T10:01:11","modified_gmt":"2018-08-24T15:01:11","slug":"canadas-top-court-dismisses-burnaby-case-against-trans-mountain-pipeline","status":"publish","type":"post","link":"https:\/\/olduvai.ca\/?p=37032","title":{"rendered":"Canada\u2019s Top Court Dismisses Burnaby Case Against Trans Mountain Pipeline"},"content":{"rendered":"<h3><a href=\"https:\/\/oilprice.com\/Latest-Energy-News\/World-News\/Canadas-Top-Court-Dismisses-Burnaby-Case-Against-Trans-Mountain-Pipeline.html\">Canada\u2019s Top Court Dismisses Burnaby Case Against Trans Mountain Pipeline<\/a><\/h3>\n<picture><source srcset=\"https:\/\/d32r1sh890xpii.cloudfront.net\/news\/420x175\/9615aec3c0b70d34c42456675130018d.jpg\" media=\"(max-width: 480px)\" \/><img decoding=\"async\" class=\"singleArticle__articleImage\" title=\"infrastructure\" src=\"https:\/\/d32r1sh890xpii.cloudfront.net\/news\/718x300\/9615aec3c0b70d34c42456675130018d.jpg\" alt=\"infrastructure\" \/><\/picture>\n<div id=\"news-content\" class=\"wysiwyg clear\">\n<p>Canada\u2019s Supreme Court on Thursday <a href=\"https:\/\/scc-csc.lexum.com\/scc-csc\/news\/en\/item\/6122\/index.do\">dismissed<\/a> an appeal by the City of Burnaby\u2014the planned end point of the Trans Mountain pipeline expansion in British Columbia on the Pacific coast, clearing another legal hurdle for the project, which still faces several lawsuits at various Canadian courts.<\/p>\n<p>The City of Burnaby was seeking to overturn a decision by Canada\u2019s National Energy Board (NEB), which <a href=\"https:\/\/oilprice.com\/Latest-Energy-News\/World-News\/Kinder-Morgan-Wins-Appeal-To-Start-Trans-Mountain-Work.html\">ruled in favor<\/a> of Kinder Morgan in December last year, saying the company is not required to comply with two sections of the City of Burnaby\u2019s bylaws as it was preparing to begin construction of the Trans Mountain Expansion Project. The NEB found that Burnaby\u2019s bylaw review process was unreasonable and caused an unreasonable delay.<\/p>\n<p>The Trans Mountain expansion has become one of the most controversial pipeline projects in North America as it pitted two provinces\u2014Alberta and British Columbia\u2014against each other.<\/p>\n<p>Alberta\u2019s heavy oil producers need more pipeline capacity as their production grows, but pipeline capacity has stayed the same. British Columbia\u2019s NDP government, which came into office last year, however, is against any new oil pipelines, although it doesn\u2019t mind all the crude it currently gets from the existing pipeline.<\/p>\n<p>The fierce opposition in British Columbia has forced Kinder Morgan to reconsider its commitment to expand the Trans Mountain pipeline, and to sell the project to the Canadian government.<\/p>\n<p>\u201cWe\u2019re disappointed that the courts seem unwilling to review decisions made by the National Energy Board that hamper municipal jurisdiction,\u201d Burnaby Mayor Derek Corrigan <a href=\"https:\/\/www.burnaby.ca\/About-Burnaby\/News-and-Media\/Newsroom\/Supreme-Court-of-Canada-rejects-Burnaby-s-request-for-Leave-to-Appeal-National-Energy-Board-Decision-that-Allows-City-Bylaws-to-be-Bypassed_s2_p6562.html\">said<\/a>, commenting on today\u2019s court ruling.<\/p>\n<p>\u201cBurnaby is not going away.
