CA Judge: Twitter Can Be Sued For Falsely Advertising They Allow Free Speech<\/a><\/h3>\n

A California judge has ruled that social media giant Twitter can be sued for falsely\u00a0advertising free speech. The judge said that Twitter\u2019s policy of banning users\u00a0\u201cat any time, for any reason or for no reason\u201d may constitute an \u201cunconscionable contract\u201d for a company which advertises free speech.<\/p>\n

The judge rejected Twitter\u2019s motion to dismiss the lawsuit from Jared Taylor, who was banned by the platform in December last year, according to Breitbart.<\/em>\u00a0<\/a>\u00a0Taylor, a self-described \u201cwhite activist\u201d may proceed with his lawsuit against Twitter because the social media company falsely\u00a0advertises free speech, yet bans users for \u201cany or no reason.\u201d\u00a0 The judge also ruled that Twitter could be sued on the basis of misleading its users, due to the platform\u2019s promise not to ban accounts on the basis of viewpoint or political affiliation, which is frequently violated.<\/p>\n

\u201cThis ruling has massive implications for the platform going forward,\u201d said Noah Peters, Jared Taylor\u2019s lawyer. \u201cthis is the first time that a social media company\u2019s argument that it can censor user speech has been rejected by a court<\/strong>.\u201d<\/p>\n

Taylor describes himself as a \u201crace realist\u201d and has\u00a0defended<\/a>\u00a0white separatism<\/a>, claiming that races are \u201cnot equal\u201d, but his attorney says this trial is not about his client\u2019s particular views, and that\u2019s a correct assessment.\u00a0 The trial is about Twitter\u2019s disallowance of free speech although they use that term to advertise the social media platform.<\/p>\n

\u201cOur lawsuit is not about whether Taylor is right or wrong,\u201d Peters\u00a0said\u00a0in February.<\/a>\u201cIt\u2019s about whether Twitter and other technology companies have the right to ban individuals from using their services<\/a> based on their perceived viewpoints and affiliations.\u201d<\/strong><\/p>\n
