{"id":30481,"date":"2018-02-02T10:35:17","date_gmt":"2018-02-02T15:35:17","guid":{"rendered":"http:\/\/olduvai.ca\/?p=30481"},"modified":"2018-02-02T10:35:17","modified_gmt":"2018-02-02T15:35:17","slug":"as-trump-unfurls-infrastructure-plan-iowa-bill-seeks-to-criminalize-pipeline-protests","status":"publish","type":"post","link":"https:\/\/olduvai.ca\/?p=30481","title":{"rendered":"As Trump Unfurls Infrastructure Plan, Iowa Bill Seeks to Criminalize Pipeline Protests"},"content":{"rendered":"<h3 id=\"page-title\" class=\"page__title title\"><a href=\"https:\/\/www.desmogblog.com\/2018\/01\/31\/iowa-bill-alec-criminalize-pipeline-protest\">As Trump Unfurls Infrastructure Plan, Iowa Bill Seeks to Criminalize Pipeline Protests<\/a><\/h3>\n<article class=\"node-12583 node node-blog node-promoted view-mode-full clearfix\">\n<div class=\"field field-name-field-bimage field-type-image field-label-hidden\">\n<div class=\"field-items\">\n<div class=\"field-item even\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.desmogblog.com\/sites\/beta.desmogblog.com\/files\/styles\/full_width_blog_image\/public\/blogimages\/dakota-access-oceti-camp-rally_2016Dec4_credit-Joe-Brusky_creative-commons.jpg?itok=I11_M-YJ\" alt=\"People rally at Standing Rock to protest the Dakota Access pipeline in December 2016\" width=\"826\" height=\"552\" \/><\/div>\n<\/div>\n<\/div>\n<div class=\"field field-name-body field-type-text-with-summary field-label-hidden\">\n<div class=\"field-items\">\n<div class=\"field-item even\">\n<p>The Iowa Senate has advanced a bill which critics say could lead to the\u00a0criminalization of pipeline protests, which are being cast as \u201cterrorist activities.\u201d\u00a0<a href=\"https:\/\/www.desmogblog.com\/energy-transfer-partners-bakken-oil-pipeline-through-iowa\" target=\"_blank\" rel=\"noopener\">Dakota Access pipeline<\/a> owner <a href=\"https:\/\/www.desmogblog.com\/directory\/vocabulary\/19688\" target=\"_blank\" rel=\"noopener\">Energy Transfer Partners<\/a> and other companies have lobbied for\u00a0the bill,\u00a0<a href=\"https:\/\/www.legis.iowa.gov\/docs\/publications\/LGI\/87\/SSB3062.pdf\" target=\"_blank\" rel=\"noopener\">Senate Study Bill 3062<\/a>, which opens\u00a0up the possibility of\u00a0prison time and a hefty fine for those who commit \u201csabotage\u201d of critical infrastructure, such as oil and gas\u00a0pipelines.<\/p>\n<p>This\u00a0bill, carrying a criminal punishment of up to\u00a025 years in prison and\u00a0$100,000 in fines, resembles the\u00a0<a href=\"https:\/\/www.desmogblog.com\/2017\/12\/11\/alec-model-bill-pipeline-protesters\" target=\"_blank\" rel=\"noopener\">Critical Infrastructure Protection Act<\/a>, a \u201cmodel\u201d bill\u00a0recently passed by the\u00a0<a href=\"https:\/\/www.desmogblog.com\/american-legislative-exchange-council\" target=\"_blank\" rel=\"noopener\">American Legislative Exchange Council (<span class=\"caps\">ALEC<\/span>)<\/a>. That <span class=\"caps\">ALEC<\/span> bill, intended as a template for state and federal legislation,\u00a0was based on\u00a0<a href=\"https:\/\/www.desmogblog.com\/2017\/04\/23\/fracking-billionaire-philip-anschutz-dhs-memo-pipeline-opponents-terrorists\" target=\"_blank\" rel=\"noopener\">Oklahoma&#8217;s <span class=\"caps\">HB<\/span> 1123<\/a>, which\u00a0calls for citizens to receive a felony sentencing, $100,000 fine, and\/or 10 years in prison if their actions \u201cwillfully damage, destroy, vandalize, deface, or tamper with equipment in a critical infrastructure\u00a0facility.\u201d<\/p>\n<p>According to <a href=\"https:\/\/www.legis.iowa.gov\/lobbyist\/reports\/declarations?ga=87&amp;ba=SSB3062\" target=\"_blank\" rel=\"noopener\">disclosure records<\/a>, corporations lobbying for the Iowa bill include not only Energy Transfer Partners, but also\u00a0<a href=\"https:\/\/www.desmogblog.com\/koch-industries-inc\" target=\"_blank\" rel=\"noopener\">Koch Industries<\/a>, the <a href=\"https:\/\/www.desmogblog.com\/american-petroleum-institute\" target=\"_blank\" rel=\"noopener\">American Petroleum Institute<\/a>,\u00a0Valero Energy,\u00a0Magellan Midstream, and others. The Iowa State Police Association has also come out in support of the bill, while the American Civil Liberties Union (<span class=\"caps\">ACLU<\/span>) of Iowa is against it.
