As Trump Unfurls Infrastructure Plan, Iowa Bill Seeks to Criminalize Pipeline Protests<\/a><\/h3>\n

The Iowa Senate has advanced a bill which critics say could lead to the\u00a0criminalization of pipeline protests, which are being cast as \u201cterrorist activities.\u201d\u00a0Dakota Access pipeline<\/a> owner Energy Transfer Partners<\/a> and other companies have lobbied for\u00a0the bill,\u00a0Senate Study Bill 3062<\/a>, which opens\u00a0up the possibility of\u00a0prison time and a hefty fine for those who commit \u201csabotage\u201d of critical infrastructure, such as oil and gas\u00a0pipelines.<\/p>\n

This\u00a0bill, carrying a criminal punishment of up to\u00a025 years in prison and\u00a0$100,000 in fines, resembles the\u00a0Critical Infrastructure Protection Act<\/a>, a \u201cmodel\u201d bill\u00a0recently passed by the\u00a0American Legislative Exchange Council (ALEC<\/span>)<\/a>. That ALEC<\/span> bill, intended as a template for state and federal legislation,\u00a0was based on\u00a0Oklahoma’s HB<\/span> 1123<\/a>, which\u00a0calls for citizens to receive a felony sentencing, $100,000 fine, and\/or 10 years in prison if their actions \u201cwillfully damage, destroy, vandalize, deface, or tamper with equipment in a critical infrastructure\u00a0facility.\u201d<\/p>\n

According to disclosure records<\/a>, corporations lobbying for the Iowa bill include not only Energy Transfer Partners, but also\u00a0Koch Industries<\/a>, the American Petroleum Institute<\/a>,\u00a0Valero Energy,\u00a0Magellan Midstream, and others. The Iowa State Police Association has also come out in support of the bill, while the American Civil Liberties Union (ACLU<\/span>) of Iowa is against it. The bill has passed out of subcommittee and next\u00a0goes in front of the state Senate Judiciary\u00a0Committee.<\/p>\n

The bill’s introduction comes as President Donald Trump<\/a>\u00a0called for Congress to pass a $1.5 trillion infrastructure bill<\/a> in his State of the Union Address, which according to a leaked outline<\/a> of his proposal published by The Washington Post<\/a>, includes pipelines and would expedite\u00a0the federal regulatory permitting process for them, largely by simply removing\u00a0environmental\u00a0requirements.<\/p>\n
