That <a href=\"https:\/\/www.usnews.com\/news\/articles\/2016-11-17\/lawmakers-resume-calls-for-james-clapper-perjury-charges\">turned out to be false<\/a>.<\/p>\n<p>More recently, Sen. <span class=\"rollover-people\" data-behavior=\"rolloverpeople\"><a class=\"rollover-people-link\" href=\"http:\/\/thehill.com\/people\/ron-wyden\" data-nid=\"188175\">Ron Wyden<\/a><\/span> (D-Ore.) asked the current director of national intelligence, <span class=\"rollover-people\" data-behavior=\"rolloverpeople\"><a class=\"rollover-people-link\" href=\"http:\/\/thehill.com\/people\/dan-coats\" data-nid=\"188223\">Dan Coats<\/a><\/span> whether the government could use Section 702 of the Foreign Intelligence Surveillance Act \u201cto collect communications it knows are entirely domestic.\u201d<\/p>\n<p>\u201cNot to my knowledge. That would be illegal,\u201d Coats responded.<\/p>\n<p>However, a subsequent letter from Coats\u2019 office to Wyden\u2019s office suggests the director\u2019s answer was incomplete. The Office of the Director of National Intelligence clarified that \u201csection 702(b)(4) plainly states we \u2018may not intentionally acquire any communication as to which the sender and all intended recipients are known at the time of acquisition to be located in the United States.\u2019 The DNI interpreted Senator Wyden\u2019s question to ask about this provision and answered accordingly.\u201d<\/p>\n<p>Wyden has since <a href=\"https:\/\/www.usnews.com\/news\/articles\/2017-06-15\/ron-wyden-asks-dan-coats-to-give-third-answer-to-question-about-domestic-surveillance\">gone on record<\/a> with his contention that the DNI did not answer his question, requesting the office provide a public response. The exchange offers insight into how intelligence agencies use semantics to obfuscate their activities, while also illustrating the frustration many privacy advocates and lawmakers encounter in the search for Section 702 surveillance transparency.<\/div>\n<div><\/div>\n<div>FISA Section 702 authorizes two major NSA snooping programs. One is \u201cupstream\u201d collection, a process in which the NSA collects digital communications through the internet\u2019s backbone \u2014 undersea cables that process large volumes of internet traffic, which internet service providers send to the government.
