Protest is Increasingly Becoming Criminalized in America<\/a><\/h3>\n

The historical space available for Americans to engage in public protest has been declining for many years, and is a topic I covered on several occasions during the Obama administration. For\u00a0instance in the post, \u00a0The War on Free Speech \u2013 U.S. Department of Justice Subpoenas Reason.com Over Comment Section<\/a>, I noted:<\/p>\n

Readers of Liberty Blitzkrieg will be well aware of the gradual erosion by the state of the civil liberties of the American public. Such\u00a0attacks are typically\u00a0sufficiently under the radar, so that the average citizen has no idea what is happening until it\u2019s too late. I have written about such calculated assaults on many occasions, but the holy grail target of the status quo is the First\u00a0Amendment of the Constitution, which enshrines\u00a0a right to the freedom of religion, speech, the press, and the right to peaceably assemble and petition the Government for a redress of grievances.\u00a0<\/em><\/p>\n

Many\u00a0aspects of the First Amendment have been neutered in practice. For example, the right to assemble peacefully and effectively is often prevented in practice by the need to secure\u00a0permits and other hindrances (see\u00a0\u201cfree speech cages\u201d and \u201cprotest zones\u201d<\/a>) . Meanwhile, on college campuses, where activism is historically most vibrant, many schools have embraced\u00a0the Orwellian\u00a0concept of \u201cfree speech zones\u201d in order to prevent free speech.<\/em><\/p><\/blockquote>\n

Unfortunately, it\u00a0appears this trend is about to get a lot worse following the DAPL protests and increased activism we\u2019ve seen since Trump\u2019s election. As\u00a0The Hill<\/em><\/a>\u00a0reports:<\/p>\n

Republican state legislators across the country are advancing bills that would criminalize or penalize some public protests just a month after millions of Americans took to the streets in opposition to President Trump.<\/em><\/p><\/blockquote>\n
