Students Are Pulling a Kaepernick All Over America \u2014 and Being Threatened for It<\/a><\/h3>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n

STUDENTS ARE BEING\u00a0threatened with punishment for not participating in rituals surrounding\u00a0the national anthem or Pledge of Allegiance \u2014 and they are fighting back.<\/p>\n

Since NFL 49ers quarterback Colin Kaepernick sat during the national anthem in August to\u00a0protest<\/a>\u00a0oppression of people of color, many Americans, particularly professional\u00a0athletes<\/a>\u00a0and\u00a0students<\/a>, have followed suit. But their constitutional right to engage in such gestures of dissent\u00a0is not always being\u00a0respected.<\/p>\n

Threats from school administrators and teachers have put free speech advocates like the ACLU on high alert. At Lely High School, a public school in Naples, Florida, the\u00a0principal told students that they would be removed from athletic events if they refused to stand during the national anthem \u2014 though he\u00a0said<\/a>\u00a0the quote was misunderstood when the ACLU of Florida reached out.<\/p>\n

\u201cYou will stand, and you will stay quiet. If you don\u2019t, you are going to be sent home, and you\u2019re not going to have a refund of your ticket price,\u201d Lely High School Principal Ryan Nemeth\u00a0told<\/a>\u00a0students.<\/p>\n

\u201cThe\u00a0Supreme Court ruled in 1943<\/a>\u00a0that public schools may not constitutionally force students to salute the flag,\u201d Lee Rowland, a First Amendment attorney who works with the ACLU, told The Intercept. \u201cThat ruling is crystal clear about a student\u2019s right not to be compelled into patriotism by their government, and it is over 70\u00a0years old.\u201d<\/p>\n

The ruling that Rowland references came after many Jehovah\u2019s Witnesses in the United States began to refuse to salute the flag in solidarity with their brethren in Nazi Germany who were being arrested for refusing to salute that country\u2019s fascist flag.<\/p>\n<\/div>\n
