The FBI is currently allowed to get certain types of information with NSLs \u2014 most commonly, information about the name, address, and call data\u00a0associated with a phone number or details about a bank account.<\/p>\n<p>Since a 2008 Justice Department legal opinion, the FBI has not been allowed to use NSLs to demand \u201celectronic communication transactional records,\u201d such as email subject lines and other metadata, or URLs visited.<\/p>\n<p>The spy bill passed the Senate Intelligence Committee on Tuesday, with the provision in it. The lone no vote came from Sen. Ron Wyden, D-Ore., who\u00a0<a href=\"https:\/\/www.wyden.senate.gov\/news\/press-releases\/wyden-opposes-2017-intelligence-authorization-act-that-expands-government-surveillance-and-undermines-independent-oversight-board\">wrote in a statement<\/a>\u00a0that one of the bill\u2019s\u00a0provisions \u201cwould allow any FBI field office to demand email records without a court order, a major expansion of federal surveillance powers.\u201d<\/p>\n<p>Wyden did not disclose exactly what the provision would allow, but his spokesperson suggested it might go beyond email records to things like web-surfing histories and other information about online behavior. \u201cSenator Wyden is concerned it could be read that way,\u201d Keith Chu said.<\/p>\n<p>It\u2019s unclear how or when the provision was added, although Sens.\u00a0<a href=\"https:\/\/cdt.org\/files\/2015\/05\/Burr-FISA-Improvements-Act-2015-Draft.pdf\">Richard Burr, R-N.C.<\/a>, \u2014 the committee\u2019s chairman \u2014 and\u00a0<a href=\"https:\/\/www.congress.gov\/bill\/114th-congress\/senate-bill\/2344\/text?q=%7B%22search%22%3A%5b%22cotton%22%5d%7D\">Tom Cotton<\/a>, R-Ark., have both offered bills in the past that would address what the FBI calls a gap and privacy advocates consider a serious threat to civil liberties.<\/p>\n<p>&#8230;click on the above link to read the rest of the article&#8230;<\/p>\n<p>&nbsp;<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Secret Text in Senate Bill Would Give FBI Warrantless Access to Email Records A PROVISION SNUCK INTO\u00a0the still-secret text of the Senate\u2019s annual intelligence authorization would give the FBI the ability to demand individuals\u2019 email data and possibly web-surfing history from their service providers without a warrant and in complete secrecy.
