{"id":13355,"date":"2015-10-13T08:19:15","date_gmt":"2015-10-13T13:19:15","guid":{"rendered":"http:\/\/olduvai.ca\/?p=13355"},"modified":"2015-10-13T08:36:20","modified_gmt":"2015-10-13T13:36:20","slug":"all-rights-reserved-now-we-know-the-final-ttp-is-everything-we-feared","status":"publish","type":"post","link":"https:\/\/olduvai.ca\/?p=13355","title":{"rendered":"All Rights Reserved: Now We Know the Final TTP is Everything We Feared"},"content":{"rendered":"<h3 class=\"headline\"><a href=\"http:\/\/www.counterpunch.org\/2015\/10\/13\/all-rights-reserved-now-we-know-the-final-ttp-is-everything-we-feared\/\" rel=\"bookmark\">All Rights Reserved: Now We Know the Final TTP is Everything We Feared<\/a><\/h3>\n<div class=\"post_content\">\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-large wp-image-75413\" src=\"http:\/\/uziiw38pmyg1ai60732c4011.wpengine.netdna-cdn.com\/wp-content\/dropzone\/2015\/10\/b-tpp-a-20150317-510x335.jpg\" alt=\"Asia-Pacific Trade Deal\" width=\"510\" height=\"335\" \/><\/p>\n<p><a href=\"https:\/\/wikileaks.org\/tpp-ip3\/\">Friday\u2019s release<\/a>\u00a0by Wikileaks of what is believed to be the current and essentially final version of the\u00a0<a href=\"https:\/\/www.eff.org\/issues\/intellectual-property\/the-term\">intellectual property<\/a>\u00a0(IP) chapter of the\u00a0<a href=\"https:\/\/www.eff.org\/issues\/tpp\">Trans-Pacific Partnership<\/a>\u00a0(TPP) confirms our worst fears about the agreement.<\/p>\n<p>And it dashes the few hopes that we held out that its most onerous provisions wouldn\u2019t survive to the end of the negotiations.<\/p>\n<p>Since we now have the agreed text, we\u2019ll be including some paragraph references that you can cross-reference for yourself \u2013 but be aware that some of them contain placeholders like \u2018x\u2019 that may change in the cleaned-up text.<\/p>\n<p>Also, our analysis here is limited to the copyright and Internet-related provisions of the chapter, but analyses of the impacts of other parts of the chapter have been published by\u00a0<a href=\"https:\/\/wikileaks.org\/tpp-ip3\/\">Wikileaks<\/a>\u00a0and\u00a0<a href=\"http:\/\/www.citizen.org\/pressroom\/pressroomredirect.cfm?ID=5662\">others<\/a>.<\/p>\n<p><strong>Binding rules for rights holders, soft guidelines for users<\/strong><\/p>\n<p>If you skim the chapter without knowing what you\u2019re looking for, it may come across as being quite balanced, including references to the need for IP rules to further the\u00a0<em>\u201cmutual advantage of producers and users\u201d<\/em>\u00a0(QQ.A.X), to\u00a0<em>\u201cfacilitate the diffusion of information\u201d<\/em>\u00a0(QQ.A.Z), and recognizing the\u00a0<em>\u201cimportance of a rich and accessible public domain\u201d<\/em>\u00a0(QQ.B.x).<\/p>\n<p>But that\u2019s how it\u2019s meant to look, and taking this at face value would be a big mistake. If you dig deeper, you\u2019ll notice that all of the provisions that recognize the rights of the public are\u00a0non-binding, whereas almost everything that benefits rightsholders is binding.<\/p>\n<p>That paragraph on the public domain, for example, used to be much stronger in the first leaked draft, with specific obligations to identify, preserve and promote access to public domain material.
