Pierce writes.<\/strong><\/p>\n<\/header>\n<div class=\"entry-content\">\n<hr \/>\n<p>When the U.S. Department of Defense published a new Law of War Manual (LOW) this past summer, editorialists at the New York Times sat up and took\u00a0<a href=\"http:\/\/www.nytimes.com\/2015\/08\/10\/opinion\/the-pentagons-dangerous-views-on-the-wartime-press.html\"><u>notice<\/u><\/a><strong><b>.<\/b><\/strong>\u00a0Their concern was that the manual stated that journalists could be deemed \u201cunprivileged belligerents.\u201d The editorial explained that as a legal term \u201cthat applies to fighters that are afforded fewer protections than the declared combatants in a war.\u201d In fact, it is far more insidious than that innocuous description.<\/p>\n<p>Here is the manual\u2019s definition: \u201c\u2018Unlawful combatants\u2019 or \u2018unprivileged belligerents\u2019 are persons who, by engaging in hostilities, have incurred one or more of the corresponding liabilities of combatant status (e.g., being made the object of attack and subject to detention), but who are not entitled to any of the distinct privileges of combatant status (e.g., combatant immunity and POW status).\u201d<\/p>\n<p><a class=\"image-anchor\" href=\"http:\/\/consortiumnews.com\/wp-content\/uploads\/2013\/07\/guantanamo-prisoners.jpg?55ac53\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-9220\" src=\"http:\/\/consortiumnews.com\/wp-content\/uploads\/2013\/07\/guantanamo-prisoners-300x300.jpg?55ac53\" alt=\"Some of the original detainees jailed at the Guantanamo Bay prison, as put on display by the U.S. military.\" width=\"300\" height=\"300\" data-lazy-loaded=\"true\" \/><\/a><\/p>\n<p>The key phrase here is \u201cbeing made the object of attack.\u201d For slow-witted New York Times editorialists, that means journalists can be killed as can any enemy soldier in wartime. \u201cSubject to detention\u201d means a journalist deemed an unprivileged belligerent will be put into military detention if captured. As with any enemy belligerent, however, if \u201ccapture is not feasible,\u201d they would be killed if possible, by drone perhaps if in a foreign country.<\/p>\n<p>Currently, most U.S. captives deemed \u201cunprivileged belligerents\u201d are imprisoned in Guantanamo although some may be held in Afghanistan.
