{"id":10718,"date":"2015-08-04T08:43:51","date_gmt":"2015-08-04T13:43:51","guid":{"rendered":"http:\/\/olduvai.ca\/?p=10718"},"modified":"2015-08-04T08:43:51","modified_gmt":"2015-08-04T13:43:51","slug":"permits-required-to-build-transcanadas-keystone-xl-pipeline-in-jeopardy-as-hearings-reveal-missteps","status":"publish","type":"post","link":"https:\/\/olduvai.ca\/?p=10718","title":{"rendered":"Permits Required to Build TransCanada\u2019s Keystone XL Pipeline in Jeopardy As Hearings Reveal Missteps"},"content":{"rendered":"<div class=\"field field-name-field-bimage field-type-image field-label-hidden\">\n<div class=\"field-items\">\n<div class=\"field-item even\">\n<h3 id=\"page-title\" class=\"page__title title\"><a href=\"http:\/\/www.desmogblog.com\/2015\/08\/03\/permits-required-build-transcanada-s-keystone-xl-pipeline-jeopardy-hearings-reveal-missteps\" target=\"_blank\">Permits Required to Build TransCanada\u2019s Keystone XL Pipeline in Jeopardy As Hearings Reveal Missteps<\/a><\/h3>\n<p><img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/www.desmogblog.com\/sites\/beta.desmogblog.com\/files\/styles\/blog_teaser\/public\/blogimages\/DSCF0366.jpg?itok=kb01Q7Px\" alt=\"\" width=\"200\" height=\"150\" \/><\/div>\n<\/div>\n<\/div>\n<div class=\"field field-name-body field-type-text-with-summary field-label-hidden\">\n<div class=\"field-items\">\n<div class=\"field-item even\">\n<p>TransCanada\u2019s decision to purchase all of the\u00a0pipe needed to complete the Keystone\u00a0<span class=\"caps\">XL<\/span>\u00a0Pipeline before receiving a\u00a0presidential permit could prove a costly\u00a0mistake.<\/p>\n<p>Not only is President Obama\u00a0<a href=\"http:\/\/www.agweek.com\/news\/nation-and-world\/3807717-obama-plans-reject-keystone-xl-nd-senator-says\" target=\"_blank\">expected to reject<\/a>\u00a0the permit TransCanada needs in order to cross the U.S.-Canadian border, the\u00a0company must recertify an expired permit before it can install the pipeline though South Dakota\u00a0as\u00a0well.<\/p>\n<p>At a hearing that began on July 29\u00a0in Pierre,\u00a0<a href=\"http:\/\/www.puc.sd.gov\/\" target=\"_blank\">South Dakota, the state Public Utilities Commission (<span class=\"caps\">PUC<\/span>)<\/a>\u00a0is\u00a0tasked to decide if\u00a0it should recertify the company\u2019s permit to\u00a0build the Keystone\u00a0<span class=\"caps\">XL<\/span>\u00a0pipeline through the state. Those opposing the Keystone\u00a0<span class=\"caps\">XL<\/span>, referred\u00a0to as interveners, are making the case that TransCanada is not up to\u00a0the\u00a0job.<\/p>\n<p>During the first week of the hearing, a mix of members of the grassroots group\u00a0<a href=\"http:\/\/dakotarural.org\/\" target=\"_blank\">Dakota Rural Action<\/a>,\u00a0Native American tribes, individual\u00a0landowners, and a team of all of the interveners\u2019 lawyers began\u00a0presenting testimony challenging TransCanada\u2019s narrative that the Keystone\u00a0<span class=\"caps\">XL<\/span>\u00a0\u201cwill be the safest pipeline ever built.\u201d The interveners claim that is a public relations ploy far from the truth about TransCanada\u2019s performance\u00a0record.<\/p>\n<p>TransCanada bears the burden to prove\u00a0it is capable of following the rules that the\u00a0<span class=\"caps\">PUC<\/span>\u00a0set when the original\u00a0Keystone\u00a0Pipeline permit was granted in 2010, so it is no surprise that the company\u00a0objected to the interveners\u2019 introduction of evidence that showed\u00a0the\u00a0company has had problems with its other recently constructed pipelines, including the\u00a0<a href=\"http:\/\/www.desmogblog.com\/2015\/05\/21\/transcanada-s-keystone-pipeline-network-under-investigation-federal-regulators\" target=\"_blank\">Keystone\u00a0<span class=\"caps\">XL<\/span>\u2019s southern route<\/a>, renamed the Gulf Coast\u00a0Pipeline.<\/p>\n<p>Lawyers for the interveners have also questioned the\u00a0<span class=\"caps\">PUC<\/span>\u2019s impartially. They believe the commissioners\u2019 pre-hearing rulings to exclude\u00a0testimony\u00a0relevant to their case was unjustified.
